Press-release: Judicial chronicles - Qplaze against «Euroinform».

As it was announced before, «Vivat Computer Service» company (ТМ Qplaze) had brought 4 suits against «Euroinform» (ТМ Otpad) company:

1. Procedure on Action № 8/19-08 according to the suit of "Vivat Computer Service" Ltd. against "Euroinform" Ltd. was started by decision of Economic court of Dnepropetrovsk region on 12.12.2007.

2. Procedure on Action № 8/357-07 according to the suit of "Vivat Computer Service" Ltd. against "Euroinform" Ltd. was started by decision of Economic court of Dnepropetrovsk region on 20.08.2007.

3. Procedure on Action № 20/48 according to the suit of "Vivat Computer Service" Ltd. against "Euroinform" Ltd. was started by decision of Kyiv Economic court 21.01.2008.

4. Procedure on Action № 20/49 according to the suit of "Vivat Computer Service" Ltd. against "Euroinform" Ltd. was started by decision of Kyiv Economic court on 21.01.2008.

By these suits, «Vivat Computer Service» (TM Qplaze) company plans to impose a penalty on «Euroinform» company in the sum of royalty under agreements acting during the period of companies’ cooperation, but were not paid by «Euroinform» company without any explanations. Also, to collect royalty for periods when agreements were dissolved but «Euroinform» despite the fact that it lost all the rights, in spite of letters of advice and claim letters from «Vivat Computer Service», continued to sell games, which are the property of «Vivat Computer Service».

On December, 24 2007 Economic court of Dnepropetrovsk region had pronounced judgement in favor of «Vivat Computer Service» company; thus, it is possible to say that the first action of four, received its legal treatment in degree of jurisdiction of first level, and company-rightholder have proved its rights in this question.

Andrey Baranovskiy, president of Qplaze said: «Of course, we glad to note that judicial system of our country works well, that we have an opportunity to fight for our rights on legal basis. We will also bring suits against infringers and pirates; it is the only way for us. Majority of companies who make living by piracy – are just cynical and dishonest people, they show no reaction on claims and appeals. They know that their business is not endless, so they try to earn as much as possible and than leave the market or duck out by all possible ways. But they just have to bear responsibility!»

«Without looking on current judicial contests of «VCS», I can say that at the present moment our products publisher – «NOMOC Publishing» company has prepared several suits against infringers of our rights – several companies in Ukraine, in Russia and in other world. I want to add to Andrey’s words, and note that we will not stand our rights ignoring and unreserved loutishness!!!», - added Boris Sheulov vice-president of Qplaze.

At the moment, we have more than 100 partners in 27 countries, the work has been arranged – so we are developing. Regarding infringements, unfortunately, there are many such facts. Claims and addresses had no effect – companies-infringers from the very beginning don’t want to work within the bounds of law, they just don’t have such plans. That’s why law firm «Guts & Isaev», representing us on the territory of CIS has begun collecting of case-based reasoning, to bring several suits against such companies. Even more, we study legislation and look for variants when we will be able to penalize pirates, and we will find such variants! Their actions cause damage to developers and publishers in CIS on the sum equal to market volumes – this is a critical line. We have to fight against it!».
